Land and Conveyancing Law Reform Bill 2013: Report and Final Stages

As I said to the Deputy, this would create major drafting problems to travel the route in full that he is suggesting. We will see how the courts applying interpret the legislation. Linking the two issues - getting stuff out of the High Court into the Circuit Court and also the personal insolvency arrangement, PIA, issue - provides certain possibilities but if anyone is in genuine financial difficulty and if there is a risk of proceedings being brought to repossess, within a matter of days the insolvency legislation will be up and running and they should take the initiative before court proceedings of any description are taken and talk to a personal insolvency practitioner, PIP. That is what I would hope many people will do. I hope that people who have the possibility of an engagement that could produce a productive outcome will not wait until they are at the receiving end of repossession proceedings, both for their own peace of mind and to avoid unnecessary expense being incurred.
