Fines Bill 2009: From the Seanad

These are technical amendments designed to ensure that the indexing provisions will apply to any enactments enacted on or after the commencement date that amend other enactments. For example, a new Act may substitute a provision to an existing Act that amends a penalty provision which can be imposed on summary conviction and these amendments will ensure that a fine will fall into one of the classes referred to in sections 4 to 8, inclusive, that is, class A, B, C, D or E. These amendments mean there will be no ambiguity as to the penalties comprehended by the indexing provisions.
