I am coming at this from a different angle. My concern is that the patient who requires care will be disadvantaged and frustrated in his or her attempt to attain that care by the unwillingness of the estranged spouse or even of a spouse who is in the house but has a particular mindset and will not cooperate. The patient is disadvantaged. The Act needs to accommodate this possibility. This will not cover it. This will seriously disadvantage people who find themselves in that situation.
