Criminal Justice Bill 2004: Report Stage (Resumed).
6:00 pm
Kathleen Lynch (Cork North Central, Labour)
Maybe I will. This section of the Bill does not refer to killing anyone. Does it matter if I shoot three burglars or does this section apply only on the street? Where is the logic in what we are about to do? I agree with this section because it will take firearms out of society, but in 25 minutes' time we will give people carte blanche to use them. It concerns me that a burglar could, quite rightly, take the gun from me and I become the victim. If this Bill reflects our attitude to firearms, that should continue into the rest of our lives.
I would like reassurance from the Minister on the three points, namely, that no other offence would be taken into consideration — it is right that this would remain within the context of having firearms with intent to endanger life, and I do not see any other reason to have a firearm — the relationship between maximum and minimum sentences and the probation service, and the question of judicial discretion.
