Disability Bill 2004: Report Stage (Resumed).

——he does not have a disability. The legislation states that a disability, in respect of a person, means "a substantial restriction in the capacity of the person to carry on a profession, business or occupation in the State or to participate in social or cultural life in the State". This does not arise in the case in question. According to the Minister of State's definition, a man in a wheelchair who cannot walk does not have a disability. That is cockeyed.
The gentleman about whom my colleague Deputy Lynch spoke is adamant, having studied this Bill and being very intelligent, that he is not covered by the definition either.
