In this case the taxpayer is liable to a bill of up to €2 billion for this debacle and the Supreme Court said the Minister could not but have known about it. He said it was beyond doubt after 2001. We know that his junior Ministers and himself were minuted at a meeting on 16 December 2003. We know he got the minutes of the MAC meeting.
