Legal and Policy Gaps in Adult Safeguarding: Discussion

Dr. Sarah Donnelly:

We argue that mandatory reporting should not be universal, and it should only apply in certain circumstances aligned with the principles of the Assisted Decision-Making (Capacity) Act and the adult at risk must be at the heart of all activities. First, it would apply in situations where the adult at risk lacks capacity to consent or there is a significant query about their ability to give capacity or understand the risks that they might be subject to.
