There are two situations. The first is where they are established in a member state of the EU. In that case, the local DSC, probably in collaboration with the European Commission, can act. There is another situation. The one the Deputy is thinking of is probably based outside the EU. Under the DSA, that does not matter. The law still applies. The only question is which Digital Service Coordinator would go after them. Normally, what is intended to happen is that the platform or service would elect to be regulated in a particular member state. That could be here. It could be anywhere. If they do not do that, it is fair game for any of the DSCs to approach that platform and begin asking questions. As of 17 February, DSCs that are established can doing that now.
