I am more interested in addressing the original question but I will also address the black box issue.

In terms of the prior notification to the public, it is pretty important to make the public disclosure to the public in a way that a layperson can understand how the technology works and how it impacts people's lives. Professor Kaye also mentioned that in the United States there are attempts at state and municipal level to restrain the use of facial identification and other technologies. Some of the legislation includes items to be disclosed to the public and the manner in how this information should be disclosed in San Francisco, for example, or New York city. The American Civil Liberties Union, ACLU, published model legislation to guarantee these points, so that source might be informative in this context.
