Joint Oireachtas Committee on Justice, Defence and Equality

General Scheme of the Garda Síochána (Recording Devices) (Amendment) Bill: Discussion

Mr. Simon McGarr:

On that point, from a practitioner's point of view, having a set definition of biometric data is a European definition. It is defined in European law. For us to attempt to redefine it for particular circumstances could frequently lead to problems later, which would be better avoided. If we mean to say facial data, we should say facial data. If we mean to use biometric data, we should remember that has been defined at a superior law level at the EU level.

That is a drafting question. These things are frequently changed and improved as we go along, but it is worth bringing it up now. Clarity is one of the necessities for this, and already you can see there is a kind of built-in lack of clarity there. We have already got a definition of biometric data but we are trying to redefine it under these circumstances.
