That requires a quality investigation - the expression used earlier - to tag an individual and be certain of their movements. The Deputy should bear in mind that when we report matters, the DPP looks at them closely. It is a high test - beyond all reasonable doubt. We need to be clear about the evidence we have gained and the quality of work we have done in terms of attempting to identify an individual. As part of our ongoing work, we see individual habitual serious criminals who go out in the public domain and are often masked. They have no expectation of privacy in the public domain. We then have to use other physical characteristics as a starting point and a follow through in the investigation.
