I move amendment No. 4:

In page 7, to delete lines 11 to 15 and substitute the following:

“ “(2) If at a trial for a rape offence the jury has to consider whether a man reasonably believed that a woman was consenting to sexual intercourse, the jury shall, in its consideration, have regard to—

(a) the steps (if any) taken by the man to ascertain whether the woman was consenting to the intercourse, and

(b) any physical, mental or intellectual disability of the man, any mental illness of his and his age and maturity.”.”.
