Under the Aarhus Convention, it is a key requirement that someone engaging in the process of taking a judicial review needs to know it will not be prohibitively expensive. Even with the outcome of the Heather Hill case, we are not quite there. That is why we believe the cost scheme is essential and provides clarity.
