The definition in the proposed new section 6(1)(a) refers to "having committed an offence". Is this offence defined somewhere? The previous section referred to a serious offence, which was defined as an offence which could carry a five-year sentence. Of course, stealing something from a shop could fall under that category. Is what constitutes an offence more widely defined or is it defined somewhere? I just do not see it in the draft Bill.
