My time is limited so I will move to the issue of subrogation. A breach of contract claim would be to put the person back in the position the person would have been in had there not been a breach and had dangerous and substandard material not been provided. Let us say there is a claim for €250,000 and the person gets an ex gratiapayment from the State of €200,000. Is the person's entire claim subrogated or is it subrogated to the limit of what the Minister has provided in the ex gratia payment?
