Next is No. 1242 B from Ms Oonagh McPhillips, Secretary General, Department of Justice, dated 16 May 2022, providing information requested by the committee regarding section 102 referrals, including international comparisons and a breakdown of the circumstances in which the referrals arose. Section 102(1) of the Garda Síochána Act 2005 requires the Garda Commissioner to refer matters to GSOC that appear to the Garda Commissioner to indicate that the conduct of a member or members of An Garda Síochána may have resulted in the death of, or serious harm to, a person.
