The State legislates for very many aspects of workers' conditions in work. Employers could make the case that minimum wage legislation is a restriction on their constitutional right to private property and right to run their businesses as they like. Clearly, however, it is largely accepted that that would not be accepted. There is clearly an accepted level of intervention on the part of the State into the relationship between employer and employee. Is Mr. Mulligan saying it would be unconstitutional to provide to certain categories of workers a right to remote working? Is that where the limit is?
