A good marketable title is one in respect of which the purchaser is able to demonstrate they have the right to sell the property and-or charge it if they are providing for a mortgage. It is one in respect of which the buyer, who will be separately represented by a solicitor, would ensure the title deeds, charges and requirements needed to prove good title exist — in other words, that the chain of ownership can be demonstrated and, if there is any hole in the change of ownership, that it can be remedied by, for example, long possession deep within the history of the property.
