Surrogacy in Ireland and in Irish and International Law: Discussion (Resumed)

Dr. Andrea Mulligan:

It is pretty simple. If we are going to allow this, we would essentially amend the 2015 Act to accommodate it. I say this because this is an issue of donation, rather than of surrogacy. Yet, as the Senator says, it is like surrogacy. However, in this scenario, both the birth mother and the genetic mother will be parents. Therefore, to my mind, this issue is a bit more like donor-assisted reproduction. If it is legal, I do not see the difficulty with simply regulating for it, as one would regulate for other kinds of donation.
