Committee on Public Petitions

Consideration of Public Petitions on Unauthorised Developments

Mr. Jack O'Sullivan:

I will not. His answer to me very simply was, and I still remember his words, that he had a word with the council's law agent about it and that agent said it could be a question of costs. To me, that was a coded message saying that the county council, as a planning authority, was reluctant or fearful of going against this very wealthy set of companies because it might lose. The companies had very deep pockets and very well-heeled barristers. The council was afraid to take a risk because if it did it would do so with public money. If it lost a case against that developer, it was sure that all hell would break loose and county councillors would attack the executive for taking such a risk. It is very hard to uphold the planning legislation in that kind of climate. That is why I have a certain degree of sympathy for county councils. This is really a matter for the Government to deal with as well.
