Yes. We have included additional safeguards so that the registered proprietor or the person in charge of a centre could be liable to be guilty of a crime and be liable to a custodial sentence or a fine if found to be guilty. Those have already existed in relation to seclusion and restraint but we are expanding it so that a person running an approved centre and it is not registered with the Mental Health Commission that person will be guilty of a crime for that reason.
