The following September the Commission responded to a written question from Mr. Chris MacManus, MEP, which stated: "It is up to the particular Member State to confirm whether the conditions of the derogation of Article 105(4) of Regulation (EU) 2019/6 are met." Our chief veterinary officer is writing to the Commission to see whether we can avail of a derogation that did not exist and the Commissioner is responding to MEPs telling them it is essentially up to member states to decide themselves whether they met the conditions of a derogation that does not exist.
