Joint Oireachtas Committee on Housing, Planning and Local Government

General Scheme of the Planning and Development (Amendment) (No. 2) Bill 2021

Mr. Eamonn Kelly:

The substitute consent piece is the retention piece and the forward-facing one is for the intensification if needs be. It was used and already existed for quarries. They would be the obvious example. Not to get into the history of it, but through the jigs and reels of the various pieces of legislation over the years, there were a number of quarries that, through no fault of the quarry developers, were overlooked for registration for an environmental impact assessment. Some 40 or 50 were brought through the process approximately ten years ago. A number of them sought to continue quarrying and that is why that particular provision is there. I do not know if that answers the Chairman's question.
