Joint Oireachtas Committee on Housing, Planning and Local Government

General Scheme of the Water Services Separation Bill 2021: Department of Housing, Local Government and Heritage

Mr. Feargal Ó Coigligh:

I will ask Ms Groarke to deal with that question. It is a company under the Companies Acts and there are annual general meetings, and so on. All of the paraphernalia of company law provisions would apply, together with the exercise of voting rights where they are required under the Companies Acts. This is not an unfettered power because power of the Ministers to act is fettered by the legislation. If people are worried about the disposal of shares, that is not possible under the scheme but I am fairly sure this is standard language in how one would describe the use of shares in legislation. Has Ms Groarke anything to add to that?
