Mental Health Services: Discussion

As I said, the emergency legislation was implemented during a unique time in this country, but as it currently stands, it is not compliant with international human rights law. From the data made available by the Mental Health Commission, some parts of the Act have not been used. Our view is that if the powers have not been used, there is no need for the Act to be there in its current form because it leaves the door open to people not getting access to the type of tribunals that they have the right to access. We have been urging the Government for the last number of months to repeal Part 5 to ensure that our legislation is as human rights-compliant as it can be.
