General Scheme of the Online Safety and Media Regulation Bill 2020: Discussion (Resumed)

I have a couple of quick questions for Mr. Herrick or Ms Cronin. In his submission, Mr. Herrick said a voluntary statutory system should be introduced that would allow social media and other online platforms to opt in to an online harms code with specific attention to children and that a regulator would oversee these standards. What happens if providers choose not to opt in?
Under head 56, Mr. Herrick raised serious concerns about regulating private communications. Has he any comments or suggestions around how criminal activity can be addressed or pursued without infringing upon private communications of individuals? Should these, criminal or otherwise, be off limits to the State?
