Is it a case that when proceedings start the State solicitor would advise the Department it should take it for granted that an order for discovery will be made at some stage in this case and, therefore, it would need to be prepared at all times for such an order of discovery?

Therefore, the Department would have to be prepared at all times for such a discovery.
