I reinforce that. The whole thing is to move away from the idea of best interests to a place where there is a reverse onus. Once the legislation is commenced, the onus will be on the State and not on the individual to prove his or her capacity. In fact, the presumption will be that there is capacity. This is really powerful and good. It is really important that we get this in place as quickly as possible.
If there were a blank slate and the delegates could make amendments at this stage to add to what is already in the legislation, what amendments would they make?
