I have read about disclosures with terms of reference relevant to March. I am raising them because the terms state that no finding is to be made on the merits or demerits of potential or possible criminal conduct. That excludes any determination by the independent investigator that this matter should go to An Garda Síochána. Is it correct that the Act itself prescribes that if there is any suspected criminality, a matter should be referred to the Garda?
