Public Accounts Committee

2018 Annual Report of the Comptroller and Auditor General and Appropriation Accounts
Vote 22: Courts Service

9:00 am

Ms Angela Denning:

If there is a capacity issue involving somebody over 18, it would normally be recorded in the court order that when he or she reaches his or her majority, the question of his or her capacity should be looked at. Usually at that point, the president of the High Court would direct that a wardship application be made. At the time the case is settled, there is usually a proviso in the order that a wardship application should be made and one does not necessarily have to wait until the child reaches 18. That is usually done immediately after the settlement.
