There are a number of considerations. The primary reason at the moment is the lack of an enforcement notice. If an enforcement notice that is the same as the 15 August letter is received, it will have a significant impact on our ability to deliver services. In our view, that impact is not supported by the law, as advised by the Data Protection Commission. As Accounting Officer, I have a responsibility to ensure I can deliver value for money for the State and good services to people. In such circumstances, of course I will appeal.
