The answer is definitively "Yes". It is in Article 40.3 of our Constitution, Article 12 of the Universal Declaration of Human Rights, Article 17 of the International Covenant on Civil and Political Rights, Article 8 of the European Convention on Human Rights, and Article 7 of the Charter of Fundamental Rights of the European Union. We have a wholesale right to privacy. It is well established and well codified. What we lack are specific laws about specific crimes, which we can address through the Law Reform Commission and our submissions. There needs to be a culture within the Garda to be able to tackle that and to have human rights-based principles and sufficient resources to take it on.
