I have checked and it would depend on the incapacity. Obviously the person would have to signal his or her intent to come back again. That would have to be notified to the Minister who would, again, reverse the decision. In other words, the temporary commissioner would then cease to be the temporary commissioner and the permanent chairperson would resume his or her office.
