This is becoming quite technical. For the benefit of non-techies, if a criminal investigation is completed the matter comes to the commission in the form of a report under section 101. Having considered the report the commission can do one of three things: it can decide that the matter should go to the DPP for her consideration as to whether any criminal charges should be proffered; it can decide that no criminality was revealed but possible disciplinary misconduct and move it into a disciplinary investigation; or under section 101(7) it can decide, having read the report, that no misconduct is evident and can just finish the case. Those are three options: DPP, discipline, or, under section 101(7), finding no misconduct and close the case.
