Joint Oireachtas Committee on Health

General Scheme of Assisted Human Reproduction Bill 2017: Discussion (Resumed)

Dr. Lydia Bracken:

We need to legislate for all circumstances but that is a matter for the Legislature to determine. There is a very small chance of somebody changing her mind but it must be included in the legislation. However, there could be a case where a court application could be made but to be determined based on the best interests of the child. That needs to be our paramount focus in any legislation. The court would then determine what is best for this child in such a case.
