Joint Oireachtas Committee on Jobs, Enterprise and Innovation

General Scheme of the Companies (Corporate Enforcement Authority) Bill 2018: Discussion

Mr. Ian Drennan:

The transcripts are the property of the court and, as I understand it, they would not be widely available. We are in possession of them and we went through certain processes before I included excerpts from them. Deputy Lawless will appreciate the retrial lasted for more than 100 days and the resultant transcripts are enormous. We included the more salient aspects concerning particular issues in the report. A number of those documents were opened in court. While I do not know if the Deputy would like me to go back into it, as I said in previous correspondence, I did not conduct an investigation or inquiry. It was, rather, a compilation of key documents. Multiple people were named in those documents. Most of them did not give evidence and none of them have had a right of reply, which gives rise to the sensitivities we have referred to earlier.
