The Personal Injuries Commission tried to look at that and see why that was. One of the reasons was that doctors assess compensation differently. A doctor could look at a soft tissue injury and decide it is severe and another doctor from the defendant's side could say that it is mild or moderate. Ultimately, judges set the standard in respect of damages and awards and then people settle.
