I am not in a position to provide legal commentary on section 10. I do not have specific cases that were before the court. As I said in my opening statement, our view is that what is unacceptable offline should be unacceptable online. Similarly, if there are offences that are clearly defined and which apply offline we support ensuring there is a corresponding offence online. We support the spirit of ensuring that if there is an offence of harassment that it also apply online. If there are any particular gaps in that, we think it would be worthwhile addressing.

In terms of cases before the courts, we have procedures for law enforcement to engage with us when it comes to gathering evidence for offences and so on. I can provide some more information on that at a later date if the committee wishes. If there is a clear offence, we can co-operate to help prosecution.
