I know that. I am not disputing that the Department does not have the powers. Surely, however, the Department of Health, although it is not a place of investigation, should be aware . Take CervicalCheck as an example. The Department was not aware of what was happening. It is not a case of having investigative powers, it is to state there may be cases where it should be aware. The Garda Commissioner has powers under legislation, which have been used on only three occasion, to notify the Minister of a specific major issue. Surely a similar situation should occur here. I ask Dr. Holohan to bear it in mind.
