There is one other issue with presenting the licence to the court. A person is not required to bring the licence to court for a non-penalty point offence. While a summons is a requirement to go to court, a person does not have to be in the court for the case to be dealt with. The court can deal with a casein absentia. A person who has been caught on camera, for example, for a speeding offence and who does not pay the fixed charge will receive a summons. If he or she does not turn up in court, the judge can still decide to deal with the case in the absence of the person. In those instances, there is no opportunity to get the driving licence.
