As a lawyer, Deputy O'Callaghan would be very familiar with Mr. Gerard Hogan's work on the use of statutory instruments by Government Departments. It is outside of the normal cut and thrust of political debate which is a worry when one is dealing with such a significant policy issue. That is the way things are, however. We are here appealing to the Members, from a policy point of view, to pay attention to it but, of course, there is a legitimacy for statutory instruments to be run through the Executive and not through the Oireachtas.
