There are very stringent checks and balances regarding the early release of records. Inserting the word "shall" is too prescriptive in making an order whereas the word "may" is perhaps more subtle. There is a suggestion that the word "shall" be inserted so that it would read: "the relevant member of the Government shall make an order requiring the transfer".
