Joint Oireachtas Committee on Children and Youth Affairs

Cybersecurity for Children and Young Adults: Discussion (Resumed)

9:30 am

Ms Niamh Sweeney:

Senator Devine asked about the details of people accused of defamation or harassment. That is a classic example of where we would work with the courts. A Norwich Pharmacal order may be issued in a case taken in that regard. The Law Reform Commission has made some proposals in terms of modifying how that works in order to streamline the process. Members may be aware of court cases reported in the newspapers regarding defamation that took place on our platform. In such cases, if the defendant was operating online under a name that does not represent his or her true identity, a court will issue an order for us to reveal that identity to the person taking the case. We must protect the privacy and personal information of our users unless an official case is in being and a direction is made by a court. We protect everybody's information until otherwise directed.
