Average home buyers should not have to decide whether to take a case against the builder, the material supplier, the contractor, the architect or the engineer. They should have an insurance product that enables them to get their house or home fixed in order that they can continue to live in it or move back into it quickly and then, if needs be, the insurance company can decide to take court cases against all the various participants.
