The Supreme Court has set the bar in relation to the eighth amendment as the right to life. It is only where there is a real and substantive risk to the life of the woman that an intervention can happen. It does not protect her health in pregnancy. How does Professor Binchy square that circle in relation to her human right to health when it is not protected in Irish law?
