Dr. T.J. McIntyre:

I am not sure this would suffice as a matter of European law. I question whether head 20 as it stands would fit the test regarding whether the powers are sufficiently clearly set out to begin with. It seems to me that especially some of the latter provisions, namely, the important objectives of general public interest and open-ended discretion as to how they are to be protected, might not even meet domestic constitutional standards.
