I can see where Deputies Daly and Wallace are coming from with their amendments. All of the guiding principles, such as the stated reasons and recommendations made by the sentencing judge, the information from the trial and the sentencing process, go to the very nature and gravity of the offence. The nature and gravity of the original offence will form part of the decision-making process because of all of the other guiding principles. Therefore, it is not necessary to specify the nature and gravity of the offence as a guiding principle.
