It seems to be a theme that the weight of right is completely with the commissioner and with this proposed office. The commissioner can make the call on whether a hearing will be held in public or private but if the person whom the hearing is about wishes to have it in public, he or she will have to apply to the commissioner in this regard. The commissioner can decide on that. Is there an appeals process? What is the back-up process if the commissioner decides to have a public hearing where the applicant wants a private hearing?
