I move amendment No. 44:

In page 51, between lines 18 and 19, to insert the following:"(4) In deciding, under subsection (3), whether to accept a recommendation that it be found that a particular contravention has occurred (or, in a case falling within paragraph (c)(ii)of subsection (3), to accept the recommendation lastly mentioned in subsection (2)(b)) the Commissioner shall have special regard to whether the particular issues of fact concerned would be more satisfactorily resolved by the Commissioner's proceeding as mentioned in Chapter 4.”.
