I am not sure if any cases ever went to court but before I was elected to the Dáil my day job involved serving wastewater notices on people to repair leaks. Whether people have gone to court or not is not the issue. Perhaps the implementation of the section needs to be streamlined and adjusted to ensure it is effective.
